Adverse possession - Section 60 of the Transfer of Land Act 1958

Adverse possession arises when an individual without legal title to a property acquires ownership through continuous and uninterrupted occupation for a minimum period of 15 years. To initiate a claim, an application must be submitted to Land Use Victoria, accompanied by documentation prepared and signed by a Licensed Surveyor. Once adverse possession is successfully established, the original owner’s legal rights are extinguished, and a new title is issued to the occupier.

Title Amendment - Section 99 of the Transfer of Land Act 1958

A Section 99 application allows a registered proprietor to amend title when the boundaries of the land described on title differ from the land they are actually occupying. This provision rectifies discrepancies between the legal title and the physical occupation of the land.

A Section 26P application is used to request the removal of a ‘warning as to dimensions’ on a title that relates to previous amendments recorded by Land Use Victoria. These warnings typically arise from non-survey-based conversions of General Law Land, which were undertaken to bring the land under the operation of the Transfer of Land Act.

Title Conversion - Section 15 of the Transfer of Land Act 1958

A Section 15 application provides the legal framework for converting General Law Land (land not previously registered under the Torrens system) into a Torrens title. This process involves submitting an application to the Registrar of Titles, accompanied by the necessary documentation signed by a Licensed Surveyor and a legal practitioner’s certificate, to formally register the land under the Transfer of Land Act.
